Light Duty Assignments for Injured Workers – Retaliation Claims

If you’ve been hurt at work and your employer demands that you return for “light duty” with the consent of your medical provider, you want an experienced, knowledgeable and capable lawyer to help you navigate this process and protect your rights.  If you return to light duty, you may receive reduced pay or reduced hours.

While this is permissible under the New Mexico Workers’ Compensation Act, you are still entitled to additional indemnity benefits to help cover some of the difference between your regular pay and your light duty assignment pay.  Also, sometimes employers do not want to provide these light duty assignments, and employees suffer retaliation and termination for needing them.  Because workplace injuries can also create rights for the employee under the Americans with Disabilities Act and the New Mexico Human Rights Act, you need an experienced attorney who knows how to address both the workers’ compensation issues and the employment laws that protect you. At Buchanan Law, we offer more than a decade of experience handling workers’ compensation cases and two decades handling employment law matters.

The Buchanan Law team bring extensive trial experience to the workers’ compensation and employment law practices. They help every step of the way, from the date you are injured up through resolution or trial of your matter.  Though our principal office is in Albuquerque, we have meeting space in Santa Fe and will meet with you in person anywhere in New Mexico.
